These Terms & Conditions govern the use of this website and the purchase of products and services supplied by PERGO VISTA, UNIPESSOAL LDA (“PergoVista”, “we”, “our”, or “us”). By using this website or placing an order with us, you agree to be bound by these Terms & Conditions.

2. Our Products & Services

PergoVista supplies bespoke aluminium pergola systems and associated outdoor living products, including but not limited to:

  • Louvred pergolas
  • Fixed roof systems
  • Retractable roof systems
  • Glass systems
  • ZIP blinds
  • Aluminium wall systems
  • Lighting and automation accessories
  • Outdoor living enhancements


Many of our systems are bespoke and manufactured to client-specific dimensions, finishes, and configurations.

3. Quotations & Orders

All quotations are subject to availability, technical review, and final specification approval.

A quotation does not constitute a binding agreement until:

  • The quotation has been accepted;
  • Any required deposit has been paid;
  • Technical details and specifications have been confirmed.

PergoVista reserves the right to amend quotations in the event of specification changes, site-related adjustments, or supplier cost variations.

4. Bespoke & Made-to-Order Products

The majority of products supplied by PergoVista are bespoke and manufactured specifically for each client.

Due to the custom nature of the products:

  • Dimensions, colours, configurations, and accessories are selected specifically for the client;
  • Manufacturing may commence following technical approval and deposit payment;
  • Materials and production scheduling may be allocated specifically to the order.

Clients are responsible for reviewing all drawings, specifications, and order confirmations carefully before approval.

5. Deposits & Payments

A deposit is required to secure production scheduling and commence project preparation.

Payment stages may vary depending on the project but commonly include:

  • Deposit payment
  • Production payment
  • Delivery payment
  • Final completion payment

     

All payment due dates are stated within quotations, invoices, or project documentation.
Failure to make payments on time may result in delays to manufacturing, delivery, or installation.
PergoVista reserves the right to suspend work or delivery until overdue balances are settled.

6. Cancellation Policy

As many PergoVista systems are bespoke and manufactured specifically for individual clients, cancellation rights may be limited once project preparation, technical approval, material procurement, engineering review, or manufacturing scheduling has commenced.

Where cancellation is requested:

  • PergoVista reserves the right to retain deposits and recover reasonable costs incurred;
  • Costs may include administration, design, technical preparation, procurement preparation, supplier scheduling, engineering review, manufacturing allocation, materials ordered, logistics planning, and associated operational costs;
  • Refund eligibility will depend on the stage of project progression, manufacturing status, and costs incurred at the time of cancellation.

Due to the bespoke and made-to-order nature of PergoVista products, once manufacturing, fabrication, or custom production has commenced, no refund shall be available unless otherwise agreed by PergoVista in writing.

Any cancellation request must be submitted in writing.

PergoVista reserves the right to suspend ongoing works, manufacturing, delivery scheduling, or installation arrangements where payments are overdue or where contractual obligations have not been met by the client.

7. Manufacturing & Lead Times

Estimated lead times are provided in good faith but are approximate only.

Lead times may be affected by:

  • Manufacturing schedules
  • Shipping delays
  • Customs procedures
  • Supplier availability
  • Weather conditions
  • Installation scheduling
  • Force majeure events
  • Port congestion or transport disruption

PergoVista shall not be liable for delays outside of its reasonable control.

Manufacturing and procurement scheduling may commence following technical approval, deposit payment, or confirmation of order progression.

Once technical drawings, dimensions, specifications, finishes, and layouts are approved by the client, responsibility for the approved specification transfers to the client.

8. Delivery

Delivery dates are estimates only and may be subject to change.

Clients are responsible for ensuring:

  • Suitable site access;
  • Safe unloading access;
  • Adequate clearance for delivery vehicles;
  • Any required lifting equipment where necessary;
  • Adequate storage space where applicable.

Where delivery cannot proceed due to site access restrictions, failed attendance, unsuitable unloading conditions, or client-related delays, additional delivery, redelivery, storage, or handling charges may apply.

Risk in goods passes to the client upon delivery.

Any visible delivery damage or shortages must be reported in writing within 48 hours of delivery.

9. Installation

Where installation is included, PergoVista or approved installation partners will carry out installation works.

Installation dates may be affected by:

  • Weather conditions
  • Site readiness
  • Access restrictions
  • Delays outside of reasonable control
  • Unsafe installation conditions


The client is responsible for ensuring the installation area is prepared appropriately prior to installation.

PergoVista reserves the right to postpone installation where weather conditions or site conditions create an unsafe working environment.

Minor snagging items or cosmetic adjustments shall not constitute grounds for withholding substantial outstanding balances.

10. Site Conditions

PergoVista accepts no responsibility for issues arising from:

  • Inaccurate site measurements provided by third parties;
  • Existing structural issues;
  • Ground movement;
  • Drainage issues;
  • Hidden utilities or obstructions;
  • Unsuitable surfaces or supporting structures;
  • Planning permission or building regulation requirements unless expressly agreed in writing.

Additional works required due to unforeseen site conditions may be chargeable.

The client remains responsible for obtaining any permissions, approvals, licences, or consents required for the installation unless otherwise agreed in writing.

11. Product Appearance & Finishes

Images, renders, brochures, and website visuals are provided for illustrative purposes only.

Due to manufacturing tolerances, lighting conditions, screen settings, powder coating processes, and material variations:

  • Colours may vary slightly;
  • Finishes may differ slightly from samples or renders;
  • Natural texture and sheen variation may occur;
  • Minor manufacturing tolerances may exist.

     

Minor variations are not considered defects.

12. Warranty

Warranty periods may vary depending on the product supplied.

Unless otherwise stated in writing, indicative warranty periods are:

  • Aluminium Structure: Up to 15 years
  • Powder Coating: Up to 8 years
  • Motors: Up to 3 years
  • Electrical Components & LED Lighting: Up to 1 year
  • Remote Controls & Accessories: Up to 1 year

Warranties are subject to:

  • Correct installation;
  • Appropriate use and maintenance;
  • No unauthorised modifications;
  • Compliance with care guidance.

Warranty claims do not cover:

  • General wear and tear;
  • Damage caused by misuse or neglect;
  • Extreme weather events beyond specified tolerances;
  • Third-party modifications;
    Lack of maintenance;
  • Failure to maintain drainage channels, moving components, or associated systems.

Wind and snow load performance may vary depending on installation method, foundations, site exposure, environmental conditions, and usage.

13. Limitation of Liability

To the fullest extent permitted by law, PergoVista shall not be liable for:

  • Indirect or consequential losses;
  • Loss of profits or business interruption;
  • Delays outside of reasonable control;
  • Third-party costs or claims.

PergoVista’s total liability shall not exceed the total contract value paid by the client.

Nothing within these Terms excludes liability where exclusion is not permitted by law.

14. Force Majeure

PergoVista shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Extreme weather
  • Shipping disruption
  • Customs delays
  • Labour shortages
  • Industrial disputes
  • Government restrictions
  • Supply chain disruption
  • Acts of war or terrorism

15. Intellectual Property

All website content, branding, brochures, drawings, renders, technical documentation, and imagery remain the intellectual property of PergoVista unless otherwise agreed in writing.

No materials may be copied, reproduced, or distributed without prior written consent.

16. Website Use

Users of this website agree not to:

  • Misuse the website;
  • Attempt unauthorised access;
  • Use the website for unlawful purposes;
  • Reproduce content without permission.

PergoVista reserves the right to suspend or restrict website access where misuse is identified.

16A. Photography & Marketing

PergoVista reserves the right to photograph completed installations for portfolio, marketing, social media, and promotional purposes unless otherwise requested by the client in writing.

17. Privacy

Personal information submitted through this website will be processed in accordance with our Privacy Policy.

Client details may be shared with approved partners or installers where necessary for quotation, delivery, installation, or project fulfilment purposes.

18. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Portugal.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the Portuguese courts unless otherwise agreed in writing.

19. Amendments

PergoVista reserves the right to update or amend these Terms & Conditions at any time without prior notice.

The latest version will always be available on our website.
